~ 243-1. Title.

  This chapter shall be entitled “A Local Law Regulating the Use of Skateboards in the Village of Fredonia.”

~ 243-2. Definitions.

  As used in this chapter, the following terms shall have the meanings indicated:

                        SKATEBOARD — Its usual and common meaning, including a single platform maintained on wheels and designed or suitable for riding underfoot or a board with roller skate wheels or other similar wheels attached to the underside without a mechanism or other device for steering while being used, operated or ridden.

~ 243-3. Skateboard riding prohibited in restricted areas.

  No person shall operate or ride any device commonly known as a “skateboard” upon or in any of the places designed in ~ 243-4 below as a restricted area.

~ 243-4. Restricted areas enumerated.

  Restricted areas are streets, highways, sidewalks, alleyways and all public areas within the following areas:

     A. That area designated on the Zoning Map of the Village of Fredonia as General Business District B-2 as the same may be amended from time to time.

     B. That area within the General Business District B-2 which is commonly known as “Barker Commons” and the Village Hall area further designed on the Zoning Map of the Village of Fredonia as Land Conservation District L-C.

     C. All streets within the Village of Fredonia as prohibited by the Vehicle and Traffic Law of the State of New York. “Streets” shall mean all roadways within the Village of Fredonia in which vehicle traffic is permitted by law.

~ 243-5. Wearing of headphones prohibited.

  Persons who ride skateboards shall not wear headphones while riding skateboards.

~ 243-6. Manner of skateboard operation.

  No person shall ride a skateboard recklessly or in such manner as to cause danger of injury to himself or to others.

~ 243-7. Responsibilities of parents and guardians.

  The parent of any child and/or the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this chapter.

~ 243-8. Trick riding on village property; skateboard facilities.

  No person riding or operating a skateboard shall perform any acrobatic, fancy stunt or trick riding upon any public right-of-way or upon any space, land, property or facilities owned or controlled by the Village of Fredonia which would tend to create a danger or hazard to pedestrians or damage to property. This section shall not prohibit skateboarding on any public facility that the Village of Fredonia specifically designates as a skateboard facility. However, any person riding or operating a skateboard on such a skateboard facility shall comply with all rules and regulations of the Village of Fredonia or its designee applying to the use of such facility.

~ 243-9. Penalties for offenses; confiscation of skateboards.

     A. A violation of any provision of this chapter shall be punishable by a fine not to exceed five hundred dollars ($500.). The police are hereby authorized to confiscate any skateboard used in violation of this chapter for a period of two (2) weeks.

     B. The parent of any child and/or the guardian of any child who authorizes, permits or allows any such child to violate any provision of this chapter shall be subject to a fine as above provided.
