~ 23-1. Duty of police to arrest.
It shall be the duty of every police officer to arrest without process and take before the Village Justice any person or persons who may be guilty, in his or their presence or within his or their sight or knowledge, of violating any of the provisions of the Act incorporating the village or of any bylaw, ordinance, rule or regulation prescribed by the Board of Trustees of the village or for any crime or misdemeanor and to make complaint thereof before the Village Justice.
~ 23-2. Hearing; sentencing.
Any Village Justice before whom any person shall be brought pursuant to the provision of ~ 23-1 shall take cognizance of any complaint alleged against any such person for any offense against the Act incorporating the village or against any bylaw, ordinance, rule or regulation prescribed by the Board of Trustees thereof and shall proceed in a summary manner to hear such complaint and, on conviction of the offender, to inflict such punishment as is, or shall be prescribed by such Act or by any such bylaw, ordinance rule or regulation.
~ 23-3. Arrest by warrant; summary hearing.
In all other cases of offenses against such Act or against any bylaw, ordinance, rule or regulation prescribed as aforesaid, the arrest shall be by warrant, and the hearing of any such complaint shall be summary, and on conviction of the offender, such punishment shall be inflicted as is or shall be prescribed as aforesaid.
~ 23-4. Imprisonment for nonpayment of fine.
In case of the nonpayment of any fine which shall be imposed upon any offender for the violation of any bylaw, ordinance, rule or regulation prescribed by the Board of Trustees thereof, such offender shall be imprisoned in the jail until such fine is paid, for a period which shall not exceed ten (10) days, as shall be adjudged by the Village Justice before whom such conviction shall be had and such fine imposed.
~ 23-5. Deposit of fines.
All money for fines or damages which shall be collected under the provisions of the Act incorporating such village or under any bylaw, ordinance, rule or regulation prescribed by the Board of Trustees thereof shall be paid to the Treasurer of such village within five (5) days after the same shall have been collected or received by any officer or person who shall have collected or received the same for the use of such village.
~ 23-6. Failure to obey fire warden; penalties for offenses. [Amended 7-2-1900 ]
Any person who shall neglect or refuse to obey any lawful order of the fire wardens of the village after the personal service of five (5) days’ notice of such order shall, upon conviction, be fined a maximum of two hundred fifty dollars ($250.) or be imprisoned for not more than fifteen (15) days, or both.
