~ 213-1. Throwing objects into fountains. [Amended 11-1-1895]

No person shall place or throw any sticks, stones, rubbish or substances of any kind into the basins of the fountains of the village or into any or either of them.

~ 213-2. Defacement of fences, trees and fountains.

Whoever shall mar, deface or injure the fences around the parks or the trees standing therein or on or along the streets or sidewalks or the fountains or the appurtenances thereto in the village shall be punished as provided in ~ 213-12 and, in addition thereto, shall be liable to pay all damages occasioned by a violation of the provisions of this section.

~ 213-3. Depositing materials on streets and sidewalks. [Amended 11-1-1895]

A. No person shall place or deposit any woods, lumber, stone, brush, wagons or other vehicles, ashes, wastepaper, decayed vegetables or vegetable substances, garbage or filth of any kind or in any manner obstruct any of the highways, streets, lanes, alleys, sidewalks or parks of the village; and whoever shall offend against the provisions of this section shall be punished as provided in ~ 213-12.

B. The party offending or the person occupying the premises adjoining the place where such articles or substances or such obstructions may be shall be notified, either verbally or in writing, to remove the same.

C. This section shall not apply to any materials deposited for making or repairing any street, lane, alley or sidewalk by any person acting under the authority or by direction of the Trustees of the village nor to any person who shall temporarily deposit, between the traveled track of any street and the sidewalk, any materials for immediate use in constructing or repairing any building on the adjoining lot, provided that the owner or person making such deposit shall, within five (5) days after such deposit is begun, obtain the written consent and permission of the President or any two (2) of the Trustees that such street may be so occupied and limiting the space so as to be occupied and the length of time such occupation may continue.

~ 213-4. Trespassing on reservoir or waterworks property. [Amended 12-28-1908]

No person shall fish, hunt, swim, skate or in any manner trespass upon the premises of the village known as the “reservoir or waterworks” without written permission by the Board of Trustees therefor.

~ 213-5. Arrest of disorderly persons.

All idlers, vagrants or tramps, disorderly, boisterous or unruly persons, unlawful assemblages or persons disturbing the public peace or any public assemblage or beggars who may be found in the village may be arrested without process and taken before any Village Justice residing in the village, and such Village Justice shall thereupon proceed to hear any complaint that may be alleged against any such person in a summary manner.

~ 213-6. Disturbing the peace on Sundays. [Amended 3-23-1910]

A. No person shall discharge any firearms or fire off or discharge any rocket, firecrackers, bombs or other fireworks within this village at any time of the day on Sunday.

B. The playing of bands on the streets of the village shall not be permitted on Sunday except where consent shall first be obtained therefor from the Board upon such terms and conditions as it may prescribe.

~ 213-7. Masks and disguises.

No person shall wear any mask, false face or other disguise in any public place in the village except on a holiday or public parade.

~ 213-8. Playing ball or cricket. [Amended 4-19-1880; 11-1-1895]

No person shall play ball or cricket in any of the streets or on the sidewalks of the village or in any or either of the parks or commons on the east side of Canadaway Creek.

~ 213-9. Flying kites. [Amended 4-19-1880; 11-1-1895]

No person shall fly a kite within the village.

~ 213-10. Disorderly houses.

No person shall keep a disorderly house, place of prostitution or house of ill fame in the village.

~ 213-11. Nude bathing. [Amended 11-1-1895]

No person shall bathe, swim or go naked in the waters of Canadaway Creek within the corporate limits of the village between the time of sunrise and 9:00 p.m. in the evening.

~ 213-12. Penalties for offenses.

Unless otherwise provided by state law or other local law, any violation of this chapter shall be punishable, upon conviction, by a maximum fine of two hundred fifty dollars ($250.) or imprisonment for not more than fifteen (15) days, or both.
