CABLE TELEVISION AND COMMUNICATIONS

~ 13-1. Title.
This chapter shall be entitled “A Local Law Establishing the Fredonia Cable Television and Communications Advisory Board.”
~ 13-2. Board created.
There is hereby created a Board which shall be referred to and known as the “Fredonia Cable Television and Communications Advisory Board.”
~ 13-3. Composition; terms; officers; vacancies; transaction of business.
A. The Board shall be composed of seven (7) members appointed by the Board of Trustees of the Village of Fredonia for two-year terms; provided, however, that of the seven (7) members first appointed, four (4) shall be for two (2) years and three (3) for one (1) year. Their successors shall be appointed for terms of two (2) years each. Members shall continue in office until their successors have been appointed and qualified.
B. A majority of the Board shall select a Chairman, Vice Chairman, Secretary and any other officers from its members as the Board may determine.
C. Vacancies in the Board shall be filled in the same manner as original appointments.
D. A majority of the Board shall constitute a quorum for the transaction of business; however, not less than a majority of the whole number of said Board may perform and exercise the power, authority or duty granted to said Board under this chapter.
~ 13-4. Residency requirement.
Board members shall be residents of the Village of Fredonia.
~ 13-5. Compensation; expenditures.
Members of the Board shall serve without compensation, except for actual and necessary expenses incurred in the cause of their duties and responsibilities upon prior approval of the Board of Trustees of the Village of Fredonia, such as travel expenses, lodgings and meals.
~ 13-6. Removal from office.
Members may be removed from office at any time by the Village Board of Trustees.
~ 13-7. Powers and duties.
The Fredonia Cable Television and Communications Advisory Board shall have the following duties:
A. To make recommendations to the Board of Trustees of the Village of Fredonia concerning any aspect of the cable television franchise with the Village of Fredonia or any proposed franchise or amendment thereto.
B. To schedule public access channel programming and to establish criteria and guidelines for programming and for public access to public channels granted by franchise agreement with the Village of Fredonia.
C. To review and make recommendations to the Board of Trustees of the Village of Fredonia on state and federal laws and regulations concerning cable television.
D. To publish an annual report on its activities and programming.
E. To recommend local laws, rules and regulations and franchise amendments necessary to carry out the functions of the Advisory Board.
F. To act as a hearing board and advisory board to the Board of Trustees of the Village of Fredonia on items concerning cable television, such as but not limited to complaints regarding line extension, access to public channels, quality of programming, sponsoring and underwriting rates, franchise rates to consumers, fees paid by the franchise holder, etc.
G. To submit an annual report on its activities to the Village Board.
H. To submit annually to the Village Board of Trustees for its approval and inclusion in the village budgetary procedures its anticipated expenses and revenues during the village fiscal year.
I. To take minutes of every meeting of the Advisory Board and file the minutes of every meeting within ten (10) days with the Village Clerk.
